If we at Languagelab.com believe the details are not correct, current, or complete, we have the right to refuse you access to the Service, or any of its resources, and to terminate or suspend your account. By using this Service you warrant that you have legal capacity to enter into the agreement set out in these Terms of Use (i.e., that you are of sufficient age and mental capacity and are otherwise entitled to be legally bound in contract).
4. Personal Information and Privacy
Personal Information is information that identifies you, including identity and billing information that you may provide to LANGUAGELAB.COM or that LANGUAGELAB.COM may collect through your use of this Service ("Personal Information"). Your Personal Information will be collected, processed, stored and used by us, and passed to and processed by us and our affiliate companies and other data processors acting under our control, in order to provide the language learning services to you and to provide customer support LANGUAGELAB.COM and any third parties acting under our control may use your Personal Information (including demographic data) to personalise the content of this Service and of your learning experience. Your Personal Information may be disclosed if we or an entity processing your data on our behalf are compelled to do so by law, or receive a valid, legally compliant request by a law enforcement or governmental authority. If you provide us a third party's billing or payment card information, we may disclose your name and address, and data relating to payments made by that payment method, to such third parties. If you provide us with payment or billing information (such as a payment card number), you agree that LANGUAGELAB.COM and its authorised data processors shall have the right to collect, store and process those details and any related Personal Information for the purpose of providing, maintaining, billing, fulfilment, monitoring usage of and making service improvements to LANGUAGELAB.COM.

WITHOUT LIMITATION, YOU (AND NOT LANGUAGELAB.COM) ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION IN THE EVENT OF ANY SUCH LOSS OR DAMAGE ARISING. THE MATERIALS, INFORMATION AND OPINIONS INCLUDED AND/OR EXPRESSED IN OR ON BULLETIN BOARDS, CHAT ROOMS, COMMUNITY PAGES, CLASSES OR OTHER FORUMS ON THIS SERVICE (“FORUMS”) ARE NOT NECESSARILY THOSE OF LANGUAGELAB.COM OR ITS AFFILIATED OR RELATED ENTITIES OR CONTENT PROVIDERS. LANGUAGELAB.COM DOES NOT UNDERTAKE TO MONITOR OR REVIEW FORUMS/CLASSES, AND THE CONTENT OF FORUMS/CLASSES IS NOT THE RESPONSIBILITY OF LANGUAGELAB.COM. LANGUAGELAB.COM MAY REMOVE OR MODIFY ANY CONTENT WITHOUT NOTICE OR LIABILITY AT ANY TIME IN ITS SOLE DISCRETION. 10. Your responsibilities
Please act responsibly when using this Service. You may only use this Service and its contents for lawful purposes and in accordance with applicable law and you are prohibited from storing, distributing or transmitting any unlawful material through this Service. (h) advertises any commercial endeavor (e.g., offering for sale products or services) or otherwise engages in any commercial activity (e.g., conducting raffles or contests, displaying sponsorship banners, and/or soliciting goods or services) except as specifically authorized on this Service;

(j) includes programs which contain viruses, worms and/or ‘Trojan horses’ or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications;

In addition, you are prohibited from removing any sponsorship banners or other material inserted by LANGUAGELAB.COM anywhere on this Service (e.g., on any web space made available for your use).
11. System Abuse
Without limitation, you agree not to send, create or reply to so called “mailbombs” (i.e., emailing copies of a single message to many users, or sending large or multiple files or messages to a single user with malicious intent) or engage in “spamming”(i.e., unsolicited emailing for business or other purposes) or undertake any other activity which may adversely effect the operation or enjoyment of this Service by any other person. You may not reproduce, sell, resell or otherwise exploit any resource, or access to any resource, contained on this Service.
12. Security
Any passwords used for this Service are for individual use only. You shall be responsible for the security of your password (if any). LANGUAGELAB.COM shall be entitled to monitor your password and, at its discretion, require you to change it. You are prohibited from using any services or facilities provided in connection with this Service to compromise security or tamper with system resources and/or accounts. The use or distribution of tools designed for compromising security (e.g. password guessing programs, cracking tools or network probing tools) are strictly prohibited. If you become involved in any violation of system security, LANGUAGELAB.COM reserves the right to release your details to system administrators at other services in order to assist them in resolving security incidents.
13. Investigations
LANGUAGELAB.COM reserves the right to investigate suspected violations of these Terms of Use, including without limitation any violation arising from any submission, posting or e-mails you make or send to any Forum. LANGUAGELAB.COM may seek to gather information from the user who is suspected of violating these Terms of Use, and from any other user. LANGUAGELAB.COM may suspend any users whose conduct or postings are under investigation and may remove such material from its servers as it deems appropriate and without notice. If LANGUAGELAB.COM believes, in its sole discretion, that a violation of these Terms of Use has occurred, it may edit or modify any submission, posting or e-mails, remove the material permanently, cancel postings, warn users, suspend users and passwords, terminate accounts or take other corrective action it deems appropriate. LANGUAGELAB.COM will fully cooperate with any law enforcement authorities or court order requesting or directing LANGUAGELAB.COM to disclose the identity of anyone posting any e-mails, or publishing or otherwise making available any materials that are believed to violate these Terms of Use. BY ACCEPTING THIS AGREEMENT YOU WAIVE AND HOLD HARMLESS LANGUAGELAB.COM FROM ANY CLAIMS RESULTING FROM ANY ACTION TAKEN BY LANGUAGELAB.COM DURING OR AS A RESULT OF ITS INVESTIGATIONS AND/OR FROM ANY ACTIONS TAKEN AS A CONSEQUENCE OF INVESTIGATIONS BY EITHER LANGUAGELAB.COM OR LAW ENFORCEMENT AUTHORITIES.
14. Service
In order to use this Service, you must obtain access to the World Wide Web and pay any service fee associated with that access. You will need to provide all equipment necessary to connect to the Service on the World Wide Web (including a computer, modem and/or other access devices). LANGUAGELAB.COM reserves the right to modify or discontinue, temporarily or permanently, all or any part of this Service and/or any software, facilities and services on this Service, with or without notice, and/or to establish general guidelines and limitations on their use.
15. Local Regulations
LANGUAGELAB.COM makes no representation that Materials or other content in the Service are appropriate or available for use in every location from which you access the Service. You access the Service on your own initiative and at your own risk. You are responsible for complying with local laws, if and to the extent local laws are applicable.
16. Indemnity
You agree to indemnify and hold harmless LANGUAGELAB.COM and its officers, directors, employees, agents, distributors and affiliates from and against any and all claims, demands, liabilities, costs or expenses, including reasonable attorney’s fees, resulting from your breach of any of the foregoing provisions, representations or warranties, and/or from your placement or transmission of any content onto LANGUAGELAB.COM’s servers, and/or from any and all use of your account.
17. Our Use of Content
LANGUAGELAB.COM will consider anything you provide to LANGUAGELAB.COM and/or contribute to this Service as available for our use free of any obligations to you, except when expressly provided otherwise. These other sites and places are not under the control of LANGUAGELAB.COM, and you acknowledge that LANGUAGELAB.COM is not responsible for the accuracy, copyright compliance, legality, decency, or any other aspect of the content of such services. The inclusion of such a link does not imply endorsement of any service by LANGUAGELAB.COM or any association with its operators. LANGUAGELAB.COM cannot ensure that you will be satisfied with any products or services that you may purchase from any third-party service that links to or from LANGUAGELAB.COM since other shop channels are owned and operated by independent retailers. LANGUAGELAB.COM does not endorse any of the merchandise or third-party services, nor has LANGUAGELAB.COM taken any steps to confirm the accuracy or reliability of any of the information contained in such third-party services. LANGUAGELAB.COM does not make any representations or warranties as to the security of any information (including, without limitation, credit card and other personal information) you might be requested to give any third party, and you irrevocably waive any claim against us with respect to such services. These Terms of Use shall be governed by, construed and enforced in accordance with the laws of England and Wales. Any action you, any third party or LANGUAGELAB.COM may bring to enforce these Terms of Use or, in connection with any matters related to the Service shall be brought only in England and Wales and you expressly consent to the jurisdiction of said courts.
If any provision of these Terms of Use shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable for this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein.
21. Use of Avatars
Service is provided only to the avatar used to register and purchased services.
22. Cancellation of Monthly Subscription
During the 7 day free trial service may be canceled at any time and no charge will be applied to your account. At all other times 30 days notice is required.
23. Courses
Payment & Refunds
- Courses must be paid in full before commencement.
- Course fees can be refunded in full up to 5 days before the start of the course.
- After commencement of the course a pro-rata transfereable credit for the course fees may be issued (at LL discretion) up to the midpoint of the course.
- All refunds are subject to a $10 processing fee except where LANGUAGELAB.COM is at entire fault.
- LANGUAGELAB.COM retains thr right to change course content without notice for academic purposes.
Joining & Registration
- LANGUAGELAB.COM reserves the right to refuse entry to a course that has already started but will endeavour to allow students to join at the earliest opportunity given the course content.
- Students are required to complete the relevant language level test before signing up to a course.
- Students missing classes may be asked to restart the next available course.
- For courses that include assessment modules LANGUAGELAB.COM reserves the right to refuse assessments to students who have not attended the relevant teaching and/or practice modules.
